These Commissioner’s Advisories are intended to provide guidance on current issues or concerns that may impact consumers and industry practitioners.  They are not intended to circumvent or supersede current Arizona Real Estate Law, Commissioner’s Rules or Commissioner's Policy Statements.

    - Guidance for using Electronic Real Estate Transaction Management Programs -
    The ADRE supports Designated Brokers who have implemented a Transaction Management for the internal standardization of document storage, as long as it adheres to the guidelines as mandated in the Arizona Statutes and Rules.  Understanding there are several computer based transaction management systems (TM), this advisory provides guidance to brokers who are using or who intend to use a transaction management system.

    - Guidance for Homebuilders, Subsequent Owners and Lenders -
    Most Arizona homebuilders continue to meet obligations to their customers.  We want to assist homebuilders including those that, declare bankruptcy, have projects that go into foreclosure, or have difficulty meeting commitments.  Our goal is to protect the Public and assist homebuilders, as possible, to meet their obligations to purchasers.

    - Guidance for Homebuyers -
    Most Arizona homebuilders continue to meet obligations to their customers.  This advisory provides guidance to homebuyers who have questions if a homebuilder fails to meet commitments.  Much of this information is applicable for homebuyers in the resale market also.

    - Rights and Responsibilities when a Real Estate Firm Closes -
    This advisory is a partial list of rights and responsibilities of parties impacted by a real estate company closing.  While a real estate firm continues to be licensed by the Arizona Department of Real Estate, all listings, escrows and other agreements legally entered into by clients with this firm remain valid and enforceable.  Agents do not have the authority to cancel or transfer agreements or escrows between clients and the brokerage.
